Introduction

Welcome to LYAAQA. By accessing and using our mobile application and services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not accept these Terms, please do not use our services.

Acceptance of Terms

By creating an account and using LYAAQA, you accept these Terms and Conditions and our Privacy Policy. These Terms constitute a legally binding agreement between you and LYAAQA.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will become effective immediately upon posting within the app. We will notify you of material changes via email or in-app notification. Your continued use after modifications constitutes acceptance of the new Terms.

User Accounts

Registration

To access LYAAQA's features, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities conducted under your account
• Immediately notifying us of unauthorized access

Account Security

You must not:

• Share your account credentials with third parties
• Create multiple accounts for fraudulent purposes
• Impersonate another person or entity

Subscription Services

Subscription Plans

LYAAQA offers premium features through paid subscription plans available via Apple's In-App Purchase system. Subscription details, including pricing and features, are displayed within the app and may vary by plan (monthly, quarterly, annual).

Payment Terms

• All subscriptions are processed through Apple's In-App Purchase system
• Payments are charged to your Apple ID account
• By subscribing, you authorize Apple to charge subscription fees automatically
• Pricing is displayed in your local App Store currency

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before renewal through your Apple ID account settings. You will be charged the then-current subscription rate.

Cancellation and Refunds

• You may cancel your subscription at any time through your Apple ID account settings
• Cancellation takes effect at the end of the current billing period
• Refunds are subject to Apple's refund policies and may be requested through the App Store
• Access to premium features continues until the end of the paid period

Free Trials

We may offer free trial periods for new subscribers. You must cancel before the trial ends to avoid charges. Trial eligibility is limited to one per user.

Acceptable Use

You agree not to:

• Use LYAAQA for illegal purposes or in violation of applicable laws
• Attempt to access restricted areas of the app or server infrastructure
• Introduce viruses, malware, or harmful code
• Copy, modify, distribute, or resell any part of our service without written authorization
• Scrape, harvest, or collect user data without permission
• Interfere with other users' access or enjoyment of the service

User Content

Ownership

You retain ownership of content you submit, display, or publish on LYAAQA (photos, workout logs, comments). By submitting content, you grant LYAAQA a worldwide, non-exclusive, royalty-free license to use, modify, reproduce, and distribute your content for providing and improving our services.

Content Responsibility

You are solely responsible for content you post. You agree not to submit content that is:

• Defamatory, obscene, offensive, or illegal
• Infringing on intellectual property rights of others
• Containing personal information of others without consent
• False, misleading, or deceptive

We reserve the right to remove content violating these Terms without notice.

Intellectual Property

All rights, titles, and interests in LYAAQA, including content, logos, trademarks, software code, and design, are the exclusive property of LYAAQA or its licensors. Unauthorized use of our intellectual property is strictly prohibited.

Limitation of Liability

To the maximum extent permitted by law, LYAAQA shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages resulting from service interruptions, errors, or unauthorized access
• Injuries or health complications arising from fitness activities

Our total liability shall not exceed the amount you paid for subscriptions in the 12 months preceding the claim.

Termination

We reserve the right to suspend or terminate your account at any time, without notice or liability, for any reason, including:

• Violation of these Terms and Conditions
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Abusive behavior toward other users or staff

Upon termination, your right to access LYAAQA immediately ceases. You remain responsible for any outstanding fees.

Apple App Store Terms

Your use of LYAAQA is also subject to Apple's Licensed Application End User License Agreement (EULA). In the event of conflict between these Terms and Apple's EULA, Apple's EULA shall control.

Changes to Services

We may modify, suspend, or discontinue any aspect of LYAAQA at any time without liability. We will provide reasonable notice of material changes affecting paid subscriptions.

Indemnification

You agree to indemnify and hold harmless LYAAQA, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the service
• Your content posted on the platform
• Your violation of third-party rights

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LYAAQA regarding use of our services.
